Bank and banking -- reorganization -- liquidation of trusteed assets for benefit of depositors -- proceedings. Under the bank reorganization act (L. 1933, c. 55) and in conformity with provisions of L. 1933, c. 259 (3 Mason Minn. St. 1940 Supp. § 8100-11, et seq.) one Cooper was duly appointed trustee and liquidating agent of a state bank in process of reorganization. Later one Rien was appointed a cotrustee but upon inadequate published notice. Rien in good faith qualified and while so acting and pursuant to court's direction brought several suits to enforce liabilities deemed beneficial to the trust estate, one of which was against said Cooper and certain other defendants. After that suit was brought and while the issues therein made were pending before a court of competent jurisdiction, Cooper and others associated with him sought removal of Rien because of alleged defect in published notice. The court granted the motion but later on Rien's motion in that behalf amended its prior order by giving him authority to proceed to final judgment with the mentioned suit.
